Syarat Penggunaan

Syarat Penggunaan Perkhidmatan ini telah dikemas kini pada bulan Mei 30, 2019. Dengan mengakses dan menggunakan Perkhidmatan GetDarkMode berikutan kemas kini tersebut, anda menyatakan bahawa anda telah membaca dan bersetuju menerima terma dan syarat yang dikemas kini bagi Terma Penggunaan Perkhidmatan ini.

Selamat datang ke Perkhidmatan GetDarkMode. Perkhidmatan 'GetDarkMode’ atau ‘Perkhidmatan’ sertakan getdarkmode.pro dan semua tapak web Internet serta sambungan penyemak imbas di mana Syarat Penggunaan ini disiarkan. Perkhidmatan dikendalikan, diurus dan disediakan oleh GetDarkMode. GetDarkMode dan semua entiti yang dikawal oleh, atau bergabung atau di bawah kawalan bersama dengan GetDarkMode secara kolektif dirujuk di sini sebagai 'GetDarkMode', 'kita', ‘kita’ atau 'kita'.

SILA BACA TERMA PENGGUNAAN INI ('TERMA') BERHATI-HATI SEBELUM MENGGUNAKAN SEBARANG PERKHIDMATAN GETDARKMODE.

  1. Perkhidmatan

    1. Perkhidmatan memberi anda maklumat, dan pelbagai alatan, ciri dan fungsi, dan membolehkan anda mencipta, menyelenggara dan mentadbir pelbagai aplikasi seperti mudah alih dan/atau aplikasi web, serta penyelesaian lain, perkhidmatan, perkhidmatan, Kandungan dan forum untuk berinteraksi dengan pengguna lain melalui program dan blog tertentu ('Perkhidmatan'). ‘Kandungan’ bermaksud data, maklumat, grafik, pautan, laman web, tanda-tanda, imej, perisian dan kod, fail, teks, foto, audio atau video, bunyi, karya visual, karya muzik, karya kepengarangan, dan komponen.
    2. Di samping itu, penggunaan Perkhidmatan dan Kandungan tertentu oleh anda juga mungkin tertakluk kepada penafian, notis undang-undang, syarat, perjanjian klik lalu atau perjanjian undang-undang lain (secara kolektif, 'Syarat Tambahan'). Syarat Tambahan ini boleh disiarkan pada Perkhidmatan atau bahagian Perkhidmatan jika berkenaan. Akibatnya, Perkhidmatan tertentu mungkin tidak boleh diakses oleh anda sehingga anda bersetuju menerima Syarat Tambahan yang berkenaan. Terma ini dan, mana berkenaan, Syarat Tambahan, membentuk perjanjian yang mengikat secara sah antara anda dan kami mengenai akses anda kepada dan penggunaan Perkhidmatan, Perkhidmatan dan sebarang Kandungan.   2. Perubahan dan Notis.

    Kami berhak, mengikut budi bicara kami, untuk meminda Terma ini dan/atau untuk mengubah suai, menukar atau menghentikan mana-mana bahagian atau semua Perkhidmatan dan/atau Perkhidmatan, pada bila-bila masa tanpa notis kepada anda. Sila semak Terma ini secara berkala untuk perubahan. Jika kami mengubah suai Terma ini secara material, kami akan menyiarkan pengubahsuaian pada Perkhidmatan. Kami juga akan mengemas kini 'Tarikh Kemas Kini Terakhir’ di bahagian bawah halaman ini. Syarat yang disemak akan berkuat kuasa apabila disiarkan ke Perkhidmatan yang berkaitan. Anda boleh mengakses Syarat yang dikemas kini dengan mengklik pada setiap Perkhidmatan’ syarat penggunaan yang disertakan di bahagian bawah setiap halaman web Perkhidmatan. Dengan terus menggunakan Perkhidmatan selepas kami menyiarkan perubahan pada Syarat, anda bersetuju untuk terikat dengan Syarat yang diubah suai. Jika Syarat yang diubah suai tidak diterima oleh anda, satu-satunya jalan anda ialah berhenti menggunakan Perkhidmatan.

  3. Akses Perkhidmatan; guna.

    1. Kami dengan ini memberi anda kebenaran untuk menggunakan Perkhidmatan, dengan syarat anda: (i) mematuhi sepenuhnya Terma ini; (ii) bukan salinan, mengedarkan atau mengubah suai mana-mana bahagian Perkhidmatan tanpa kebenaran bertulis kami terlebih dahulu; (iii) tidak menghantar iklan yang tidak diminta atau tidak dibenarkan, spam, surat berantai, dll.; dan (iv) tidak mengganggu pelayan atau rangkaian yang disambungkan kepada Perkhidmatan.
    2. Anda bersetuju untuk tidak: (i) mengakses atau menggunakan Perkhidmatan, Perkhidmatan dan/atau Kandungan dalam apa jua cara yang boleh merosakkan, melumpuhkan, membebankan, atau menjejaskan mana-mana akaun kami, sistem atau rangkaian komputer; dan (ii) cuba mendapatkan akses tanpa kebenaran kepada mana-mana bahagian Perkhidmatan, Perkhidmatan dan/atau Kandungan, sistem atau rangkaian komputer. Anda bersetuju untuk tidak mengganggu atau cuba mengganggu kerja Perkhidmatan yang sepatutnya atau mana-mana akaun kami, sistem atau rangkaian komputer.
    3. Akses kepada dan penggunaan kawasan Perkhidmatan yang dilindungi kata laluan atau selamat adalah terhad kepada pengguna yang dibenarkan sahaja.
    4. Anda bersetuju untuk tidak menggunakan atau melancarkan sebarang sistem automatik, termasuk tanpa had, 'robot', 'crawler', 'labah-labah', dan/atau ‘pembaca luar talian’ yang mengakses Perkhidmatan dengan cara yang menghantar lebih banyak mesej permintaan kepada pelayan kami dalam tempoh masa tertentu daripada yang boleh dihasilkan oleh manusia secara munasabah dalam tempoh yang sama dengan menggunakan pelayar web dalam talian konvensional. Kami memberi kebenaran kepada pengendali enjin carian awam untuk menggunakan labah-labah untuk menyalin bahan daripada Perkhidmatan untuk tujuan semata-mata untuk mencipta indeks bahan yang boleh dicari secara terbuka., tetapi bukan untuk cache atau mengarkibkan bahan tersebut.
    5. Anda bersetuju untuk tidak mengumpul atau menuai sebarang maklumat yang boleh dikenal pasti secara peribadi, termasuk nama akaun atau alamat e-mel, daripada Perkhidmatan, mahupun menggunakan sistem komunikasi yang disediakan oleh Perkhidmatan untuk sebarang tujuan permintaan komersial. Anda bersetuju untuk tidak meminta, untuk tujuan komersial, mana-mana pengguna Perkhidmatan berkenaan dengan Penyerahan Pengguna mereka (seperti yang ditakrifkan di bawah) atau sebaliknya.
    6. Sesetengah Perkhidmatan kami membenarkan penggunaan komersial seperti yang ditetapkan secara khusus berkaitan dengan Perkhidmatan tersebut. Semua penggunaan komersil Perkhidmatan dan/atau Perkhidmatan mestilah menurut terma di sini dan terma khusus yang berkaitan dengan Perkhidmatan tersebut. Penggunaan Perkhidmatan yang tidak sah dan/atau tidak dibenarkan, Perkhidmatan dan/atau sebarang Kandungan, atau mana-mana bahagian daripadanya, termasuk, tetapi tidak terhad kepada, pembingkaian atau pemautan tanpa kebenaran kepada Perkhidmatan adalah dilarang. Sebarang penggunaan sedemikian akan dianggap sebagai pelanggaran Terma ini.

  4. Akaun dan Kata Laluan.

    1. Untuk mengakses beberapa ciri Perkhidmatan, anda perlu membuat akaun. Dengan mencipta akaun anda, anda bersetuju untuk memberikan kebenaran, tepat, maklumat terkini dan lengkap tentang diri anda seperti yang digesa oleh proses pendaftaran kami, dan untuk mengekalkan dan mengemas kini maklumat anda, mengikut keperluan. Anda bersetuju untuk tidak berkongsi akaun anda, kata laluan atau maklumat akaun lain. Anda tidak boleh menggunakan akaun pengguna lain tanpa mendapatkan kebenaran bertulis terlebih dahulu. Anda tidak boleh menyamar sebagai mana-mana orang atau entiti atau menyalahgambarkan identiti atau pertalian anda dengan mana-mana orang atau entiti, termasuk menggunakan nama pengguna orang lain, kata laluan atau maklumat akaun lain, atau nama orang lain, keserupaan, suara, imej atau gambar.
    2. Anda bertanggungjawab sepenuhnya untuk mengekalkan kerahsiaan akaun anda, kata laluan atau maklumat akaun lain dan untuk sebarang aktiviti yang berlaku pada akaun anda, dan anda mesti memastikan kata laluan akaun anda selamat. Anda mesti memberitahu kami dengan segera tentang sebarang pelanggaran keselamatan atau penggunaan tanpa kebenaran akaun anda atau sebarang pelanggaran keselamatan lain yang anda ketahui melibatkan atau berkaitan dengan akaun anda. Anda akan bertanggungjawab untuk sebarang penggunaan akaun atau kata laluan anda, termasuk tanpa had, kerugian kami disebabkan oleh sebarang penggunaan tanpa kebenaran akaun anda. Kami tidak akan bertanggungjawab ke atas sebarang kerugian yang ditanggung oleh anda atau sesiapa sahaja bagi pihak anda yang disebabkan oleh sebarang penggunaan tanpa kebenaran akaun anda.
    3. Anda bersetuju untuk memberitahu kami dengan segera tentang sebarang penggunaan tanpa kebenaran akaun anda, kata laluan atau maklumat akaun lain.

  5. Pemilikan dan Lesen – GetDarkMode.

    1. GetDarkMode mengekalkan semua betul, tajuk dan minat dalam dan kepada Perkhidmatan, Perkhidmatan dan Kandungan, dan sebarang derivatif daripadanya, termasuk mana-mana Hak Harta Intelek yang terkandung dan/atau disediakan di dalamnya atau berkaitan dengannya (secara kolektif, 'IP GetDarkMode'). Seperti yang digunakan di sini, ‘Hak Harta Intelek’ bermaksud ciptaan dan paten apa-apa jenis, hak reka bentuk, model utiliti atau hak ciptaan lain yang serupa, hak cipta, tanda dagangan, tanda perkhidmatan, nama dagangan, pakaian perdagangan, logo, hak rahsia perdagangan atau kerahsiaan, dan sebarang hak harta tak ketara yang lain termasuk dalam kod perisian, reka bentuk, susun atur, ‘tengok & rasa', proses, susunan, pangkalan data dan aplikasi untuk mana-mana perkara di atas, di mana-mana negara, yang timbul di bawah undang-undang berkanun atau biasa atau melalui kontrak dan sama ada disempurnakan atau tidak, kini sedia ada atau selepas ini difailkan, dikeluarkan, atau diperolehi.
    2. Semua penggunaan IP GetDarkMode akan memberi manfaat kepada GetDarkMode, dan kamu tidak boleh: (i) pertandingan, atau membantu orang lain untuk bertanding, hak atau kepentingan kami dalam dan terhadap IP GetDarkMode atau kesahihan hak kami dalam dan pada IP GetDarkMode dan semua aplikasi, pendaftaran atau kepentingan lain yang diiktiraf di sisi undang-undang di dalamnya, atau (ii) berusaha untuk mendaftar, rekod, mendapatkan atau cuba mengejar sebarang Hak Harta Intelek atau hak atau perlindungan proprietari lain dalam atau ke IP GetDarkMode tersebut. Semua hak dalam IP GetDarkMode yang tidak diberikan secara nyata di sini adalah terpelihara oleh GetDarkMode. Anda dengan ini bersetuju untuk menyerahkan dan menyerahkan kepada GetDarkMode sebarang pengubahsuaian, karya terbitan atau pengganti mana-mana Perkhidmatan dan/atau Kandungan yang dibuat oleh anda yang bertentangan dengan had di atas.
    3. Anda bersetuju untuk tidak mengalih keluar, mengaburkan atau mengubah sebarang notis Hak Harta Intelek atau penafian yang terdapat dalam atau pada Perkhidmatan, Perkhidmatan dan/atau Kandungan.
    4. Penggunaan hak cipta GetDarkMode, tanda dagangan, tanda perkhidmatan, nama dagangan, pakaian perdagangan, logo atau ciri jenama lain (secara kolektif 'Ciri Jenama') dimiliki sepenuhnya oleh syarikat GetDarkMode yang berkenaan. Sebarang penggunaan Ciri Jenama, dan sebarang muhibah daripadanya, akan menanggung manfaat GetDarkMode, dan hendaklah tertakluk pada Ciri Jenama GetDarkMode’ Garis panduan. Jika anda ingin mendapatkan kebenaran untuk menggunakan mana-mana Ciri Jenama kami, sila hubungi info@getdarkmode.pro.
    5. Setakat yang kami meminta Penyerahan Pengguna (ditakrifkan di bawah) melalui ciri atau aktiviti pada atau melalui Perkhidmatan(termasuk permainan, cabutan bertuah, pertandingan, promosi dan blog yang memerlukan penggunaan IP GetDarkMode kami (secara keseluruhan atau sebahagian), kami dengan ini memberikan anda lesen bukan eksklusif seperti yang diperlukan semata-mata untuk tujuan membuat Penyerahan Pengguna anda; dan tertakluk kepada syarat-syarat 6.2 di sini.

  6. Pemilikan, Lesen dan Peraturan – Penyerahan Pengguna.

    1. Beberapa bahagian Perkhidmatan(seperti papan mesej, blog, forum, undian atau ulasan) boleh memberi anda dan pelawat lain Perkhidmatan peluang untuk menyerahkan, jawatan, paparan, menghantar dan/atau bertukar maklumat, idea, teks, pendapat, gambar-gambar, imej, video, gubahan muzik (termasuk lirik), rakaman bunyi, perwatakan, karya kreatif atau maklumat lain, mesej, penghantaran atau bahan, termasuk nama dan rupa anda, ke GetDarkMode atau lain-lain (secara kolektif, 'Penyerahan Pengguna').
    2. Dengan menyiarkan, menyerahkan atau memuat naik Penyerahan Pengguna ke mana-mana bahagian Perkhidmatan, anda mewakili dan menjamin bahawa ia mematuhi Terma ini, dan anda mengakui dan bersetuju bahawa anda memberikan GetDarkMode, yang kekal, tidak boleh ditarik balik, tidak terhad, seluruh dunia, bebas royalti, boleh dipindah milik (secara keseluruhan atau sebahagian), boleh disublesenkan, hak dan lesen kepada ('Lesen Penyerahan Pengguna'): (a) gunakan, membiak, salinan, paparan, cipta karya terbitan daripada, lesen, ubah suai, menyesuaikan diri, menerbitkan, menterjemah, mengedarkan, melaksanakan, pameran, tuan rumah, cache, kedai, arkib, indeks, mengkategorikan, mengulas tentang, tag, menghantar, siaran, edit, ubah suai, selaras dengan bahan visual, digabungkan dalam karya lain dalam apa jua bentuk, media, atau teknologi yang kini dikenali atau dibangunkan kemudiannya, untuk tempoh penuh mana-mana hak yang mungkin wujud dalam Penyerahan Pengguna tersebut dan transkodkan Penyerahan Pengguna kepada format media yang sesuai, piawaian atau medium (dalam setiap kes di atas, secara keseluruhan atau sebahagian); dan (b) tawaran untuk menjual, jual, pajakan, menyerahkan dan sebaliknya memindahkan kepada pihak ketiga hak untuk menggunakan, pameran dan sebaliknya gunakan, mengeksploitasi atau mengedarkan Penyerahan Pengguna (secara keseluruhan atau sebahagian dan seperti yang diubah oleh GetDarkMode mengikut budi bicara mutlaknya) seluruh dunia untuk selama-lamanya, dalam mana-mana dan semua media, whether now existing or hereafter developed, without compensation to you for any and all purposes including entertainment, news, advertising, promotional, marketing, publicity, trade or commercial purposes, all without further notice to you, with or without attribution to you, and without the requirement of any permission from or payment to you or to any other person or entity. You represent and warrant that: (a) you have the right and authority to grant the User Submission License to us; (b) our exercise of the rights granted pursuant to the User Submission License will not infringe or otherwise violate any third party rights; dan (c) all so-called ‘moral rights’ in the User Submission have been waived to the fullest extent allowed by law.
    3. Subject to the User Submission License you grant to the GetDarkMode hereunder, you shall continue to retain all rights in and to your User Submission. Nothing in these Terms shall limit you from selling or licensing your User Submission to any other person or entity.
    4. You represent and warrant to the GetDarkMode that your User Submission is original work made or created by you or that you have all right, title, and/or authority to grant the User Submission License to the GetDarkMode. In addition, you represent and warrant that your User Submission does not infringe or violate any rights of any third party or entity, termasuk, without limitation, copyright, trademark, defamation, privacy, publicity or any other similar right. If your User Submission include images, photos or video of individuals other than you, then before you post such User Submission, you warrant that you have the express consent of everyone who appears in the User Submission in order to submit the User Submission for use, exhibition and other exploitation in any manner and in any and all media, whether now existing or hereafter discovered, throughout the world, in perpetuity. If you submit an image of someone who is under 18 years of age who is not your child, you must have the permission of that child’s parent or legal guardian.
    5. You grant the User Submission License to the GetDarkMode whether or not your User Submission (or any part thereof) is actually posted on the Services or used by the GetDarkMode. You acknowledge and agree that the GetDarkMode may, at its sole discretion, elect to post or not post your User Submission on any Services, or to remove your User Submission from any Services after it has been posted or published, at any time, for any reason and without notice, and not to use, exhibit or otherwise exploit your User Submission in any manner whatsoever. You further acknowledge and agree that you post, submit or upload your User Submission voluntarily, and not in confidence, and that no confidential relationship is intended or created between the GetDarkMode, and/or any other person or entity, on the one hand, and you, on the other hand, by your submission of the User Submission.
    6. You are solely responsible for your User Submission and any consequences of posting or publishing it on the Services whether as part of a message board, forum, blog or otherwise. These sections of the Services are public and not private, and you acknowledge and agree that you have no expectation of privacy with respect to any User Submission posted or published in any such section of the Services. Please carefully consider the User Submission you choose to post on any section of the Services. You should not include personal information such as your full name, telephone number or street address as part of your User Submission. We cannot guarantee the security of any information you disclose through the Services; you make such disclosures at your own risk.
    7. You agree that your User Submission (or any content made available therein) will not: (i) be unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes; (ii) create a risk to a person’s safety or health, to public safety or health, compromises national security, or interferes with an investigation by any law enforcement; (iii) promote illegal drugs, violates export control laws, relate to gambling, or arms trafficking; (iv) be unlawful, defamatory, abusive, libelous, threatening, harmful, vulgar, obscene, profane, pornographic, harassing, hateful, inaccurate, racially or ethnically offensive, or otherwise objectionable material or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any applicable local, state, national or international law or regulation; (v) infringe or violate any right of a third party including: (a) copyright, patent, trademark, trade secret or other proprietary or contractual rights or rights for privacy; atau (b) any confidentiality obligation; (vi) contain any virus or other harmful component, or otherwise tamper with, impair or damage the Services or any connected network, or otherwise interfere with any person or entity’s use or enjoyment of the Services; atau (vii) include any ‘flaming’, ‘spamming’, ‘flooding’ and/or ‘trolling’ mechanism, as those terms are commonly understood and used on the Internet.
    8. You understand that when using the Services, you may be exposed to User Submissions, from a variety of sources, that may be inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you may have against us with respect thereto, and agree to indemnify and hold us harmless to the fullest extent allowed by law regarding all matters related to your User Submissions.
    9. We do not permit copyright infringing activities and infringement of Intellectual Property Rights on our Services, and we will remove all content and User Submissions, if properly notified in accordance with our Copyright Policy, that infringe on any person or entity’s Intellectual Property Rights.
    10. Further, while the GetDarkMode has no obligation to monitor the Services and/or to screen or review User Submissions prior to or after its posting to any area of the Services, we do reserve the right to review the Services and User Submissions and to monitor all use of and activity on the Services, and to remove or choose not to make available on or through the Services any User Submission at our sole discretion. In addition, we will cooperate fully with any law enforcement officials and/or agencies in the investigation of any person or persons who violates these Terms.
    11. As part of the submission process of any User Submission to any message board, blog or forum or any other area on the Services, you may be required to provide your e-mail address and you may receive notification via e-mail whenever a new post was submitted in any such areas.
    12. You are solely responsible for any interaction with other users or visitors of the Services. We reserve the right but shall have no obligation to monitor disputes between you and any other user or visitor of the Services.

    7. NOTWITHSTANDING ANYTHING CONTAINED HEREIN TO THE CONTRARY, BY POSTING, SUBMITTING, OR UPLOADING A USER SUBMISSION TO ANY MESSAGE BOARD, BLOG, FORUM, SWEEPSTAKES, OR ANY OTHER AREA ON THE SERVICES, YOU HEREBY EXPRESSLY PERMIT THE GetDarkMode TO IDENTIFY YOU AS THE CONTRIBUTOR OF SUCH USER SUBMISSION IN ANY PUBLICATION IN ANY FORM, MEDIA OR TECHNOLOGY NOW KNOWN OR LATER DEVELOPED IN CONNECTION WITH YOUR USER SUBMISSION, UNLESS YOU OTHERWISE NOTIFY THE GetDarkMode AT info@getdarkmode.pro AT THE TIME YOU SUBMIT YOUR USER SUBMISSION THAT YOU DO NOT WISH TO BE IDENTIFIED.

  7. Privasi

    1. The privacy policy posted on the Service at getdarkmode.pro/etc/pages/privacy explains how we access, collect and use information that is generated by your use of that Site, Perkhidmatan dan/atau Kandungan. By using the Service where these Terms are posted, you consent to our use of your data in accordance with the relevant privacy policy.
    2. Certain third party service providers operating on our behalf may collect information about you from our Services using cookies. These third party service providers use the information they collect to deliver relevant ads to you while you visit certain pages of these Services. Any third parties using cookies on our Service(s) to collect information about you are required to comply with applicable privacy laws and practices.     3. You agree that we may access, preserve and disclose your information and/or User Submission if we reasonably believe that it is required to: (i) comply with applicable law, regulation, legal process, subpoena or governmental request; (ii) enforce these Terms, including investigation of potential violations of it; (iii) mengesan, mencegah, or otherwise address fraud, security or technical issues; (iv) respond to claims that any User Submission violates the rights of third parties; atau (v) respond to user support requests.

We reserve the right at all times to disclose any information that we deem necessary to comply with any applicable law, regulation, legal process or governmental request. IF, NOTWITHSTANDING THE OTHER PROVISIONS OF THESE TERMS, THE GetDarkMode IS FOUND TO BE LIABLE TO YOU FOR ANY DAMAGE OR LOSS WHICH ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH YOUR USE OF THE SERVICES, SERVICES OR CONTENT, GetDarkMode’S LIABILITY SHALL IN NO EVENT EXCEED THE AMOUNT OF US$500. THE LIMITATIONS, EXCLUSIONS AND DISCLAIMERS IN THIS SECTION AND ELSEWHERE IN THESE TERMS APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY, SUCH AS FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

  11. Indemnification

    You agree to defend, indemnify and hold harmless the GetDarkMode, and its respective officers, directors, employees and agents, licensors, licensees, distributors, agents, representatives and other authorized users, and each of the GetDarkMode entities’ respective resellers, distributors, service providers and suppliers (secara kolektif, the ‘Indemnified Parties’) from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including but not limited to attorney’s fees) incurred by the Indemnified Parties in connection with or arising from: (i) your use of the Services, the Services and/or the Content; (ii) your violation of these Terms and/or any Additional Terms; (iv) your violation of any third party right, including without limitation any copyright, harta, publicity or privacy right; atau (v) any claim that one of your User Submissions caused damage to a third party. You shall use your best efforts to cooperate with us in the defense of any claim.     2. You agree that in the event we discontinue, terminate or suspend your account, you shall not attempt to re-register with or access the Services or Services through use of a different user name or otherwise.
    3. You also agree that any violation by you of these Terms will constitute an unlawful and unfair business practice, and will cause irreparable harm to the GetDarkMode, for which monetary damages would be inadequate, and you consent to the GetDarkMode obtaining any injunctive or equitable relief that we deem necessary or appropriate in such circumstances. These remedies are in addition to any other remedies we may have at law or in equity.
    4. If any member of the GetDarkMode does take any legal action against you as a result of your violation of these Terms, such member will be entitled to recover from you, and you agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief granted to such member of the GetDarkMode. You agree that we will not be liable to you or to any third party for termination of your access to the Services or the Services as a result of any violation of these Terms.

  14. Umum

    You agree that any action at law or in equity arising out of or relating to these Terms, the Privacy Policy and the relationship between you and us shall be governed by and construed in accordance with the laws of the State of New York, without regard to its principles of conflict of laws. You agree to submit to the personal and exclusive jurisdiction of the federal and state courts located in New York, New York and waive any jurisdictional, venue, or inconvenient forum objections to such courts. These Terms, together with the Privacy Policy and any Additional Terms (secara kolektif, the ‘Complete Terms’) shall constitute the entire agreement between you and us in connection with or in relation to the Services, the Services and any Content. You may not assign your rights under this Terms to any party without GetDarkMode’s consent. GetDarkMode may assign or transfer these Terms or any rights or delegate any obligations of GetDarkMode hereunder to any third party at its sole discretion and without providing any notice to you nor obtaining your consent. GetDarkMode will be released of all rights or liabilities under these Terms upon consummation of such assignment, transfer or delegations.

  15. Survival

    Your confidentiality and indemnification obligations hereunder, and the terms of Sections, 6, 9, 10, 11, 14 and this Section 15 shall survive the termination of your access and use of the Services.
